On August 15, 2019, President Uhuru Kenyatta gazetted the reinstatement of Supreme Court Judge Jacktone Ojwang, who had been suspended.
According to Uhuru, the suspension of Justice Jacktone Ojwang was lifted in accordance with the recommendations of the Tribunal, and he was reinstated to office with all remunerations and benefits adjusted during the term of his suspension.
The decision to reinstate Ojwang was made since there had been no appeal against the decision of the tribunal, which cleared him of all four charges that led to his suspension last week.
The charges included misconduct, impropriety, conflict of interest, and breach of the judicial code of conduct.
Justice Ojwang was accused of sitting on the bench over some of the court cases, including delivering a favourable ruling to Migori Governor, Okoth Obado, in exchange for commissioning of roadworks to his residence.
Uhuru formed a tribunal following recommendations by the Judicial Service Commission, led by Chief Justice David Maraga, to look into the matter.
Justice Alnasir Visram was appointed by the President to chair the tribunal, which investigated Ojwang's conduct and absolved him of any wrongdoing after analyzing evidence from more than 15 witnesses.
The tribunal handed its findings to Uhuru and recommended that he lifts the suspension imposed on Ojwang and that the judge resumes work with immediate effect.
