On July 18, 2007, Abdulahi Abdi Alinur signed a long-term lease agreement with Kenya Railways Corporation (KRC) to use the land for his business.
He invested Sh21 million in developing the property, including a godown, 15 business premises, a car wash, and a house, with much of the money being loans.
Abdulahi, who sued as Baraka Shopping Complex, is seeking compensation for the losses he will incur due to the demolition of the structures and developments on the property.
On August 8, Judge Jesse Njagi issued an order barring KRC from evicting Abdulahi until the matter is heard and determined.
On August 15, 2019, Kakamega Presiding Judge William Musyoka extended the order, stating that the case will be heard on August 28, 2019.
