On August 14, 2019, the Consumers Federation of Kenya (COFEK) obtained a court order to maintain the status quo at the Communications Authority of Kenya, pending the determination of a case filed against the authority.
The case, which is set to be heard on August 27, 2019, seeks to prevent the recruitment of a new Director General to replace Francis Wangusi, whose term is set to expire.
COFEK argued that the planned recruitment is unlawful, as there is no legitimate board in place at the Communications Authority of Kenya.
Employment and Labour Relations Court judge Maureen Onyango directed COFEK lawyer Henry Kurauka to serve the Communications Authority, the Public Service Commission, and the Attorney General with the court papers.
According to the application, the situation is 'extremely urgent' and requires the court's intervention to prevent the unlawful recruitment of Mr. Wangusi's successor.
COFEK also cited ongoing separate cases challenging the lawfulness of the amended Section 6B of The Kenya Information and Communications Act, 1998, which has worsened the situation.
