On Tuesday, a Mombasa court freed Bofu Ward Member of County Assembly (MCA) Ahmed Salama Omar, who was arrested in connection to drug trafficking, due to lack of evidence.
The court's decision came after the prosecution requested to detain Mr. Omar for three more days pending completion of investigations, but the court rejected the request, citing that the accused had presented himself to the police prior, giving them adequate time to conduct their probe.
Mr. Omar was among 18 others arrested on Monday after Interior Cabinet Secretary Dr. Fred Matiang'i launched a crackdown on drugs in Mombasa County.
During the operation, 42 heroin sachets, 147 rolls of bhang, and Ksh.608,000 in fake currency were recovered.
According to Magistrate Edgar Kagoni, the prosecution did not prove beyond reasonable doubt why the defendant should continue being remanded.
