On Tuesday, August 13, 2019, the High Court dismissed a petition to stop debates on the Punguza Mizigo bill in county assemblies.
The petition, filed by David Ngari, had argued that the Independent Electoral and Boundaries Commission (IEBC) made a mistake in approving the 1.2 million signatures supporting the initiative without verification.
Ngari also questioned the competence and technical capacity of the IEBC to admit the process and approve the proposed bill as presented by the Thirdway Alliance party.
However, the court ruled in favor of the Thirdway Alliance party, allowing debates on the bill to proceed.
Earlier, a week ago, High Court Justice James Makau had stopped the debate on the bill, pending determination of suits challenging the process.
Justice Makau had also stopped the Dr Ekuru Aukot-led party from presenting the proposals to the Speaker of the National Assembly, Justin Muturi, for debate.
Meanwhile, the hearing of a case involving Dennis Itumbi, who was charged with a letter claiming that a section of Cabinet Secretaries and politicians from Mount Kenya were planning to assassinate Deputy President William Ruto, will proceed on September 2 and 3.
