On February 10, 2018, two rugby players, Alex Mahaga Olaba and Lawrence Frank Wanyama, allegedly gang raped an upcoming musician at their Seefar Apartments residence in Highrise, Nairobi.
The suspects recorded the entire ordeal, but deleted the video recordings when they learned the victim was planning to seek legal redress.
Chief Magistrate Martha Mutuku found the two guilty and noted that deleting the videos was an action of guilt.
The defence lawyers requested non-custodial sentences for the two players, citing that a custodial sentence would dash their dreams. However, the prosecution argued that the Sexual Offences Act provides for a mandatory sentence of 15 years to life.
The sentencing, initially set for August 16, 2019, has been postponed.
Kenya Harlequin FC players Olaba and Wanyama are set to remain in custody until sentencing.
