On February 10, 2019, a musician was brutally gang-raped by two Kenya Harlequin FC players, Alex Mahaga and Frank Wanyama, at Seefar Apartments in Highrise, Nairobi.
According to the victim's testimony, she was drugged and helpless as the two men took advantage of her. She claimed that she was in denial, shock, pain, and exhausted after the ordeal.
Magistrate Martha Mutuku found the victim's testimony more believable than that of the accused. The magistrate held that there was no express consent of intercourse and that the duo's decision to delete the video recordings of the incident was an action of guilt.
On August 9, 2019, the two rugby players were found guilty of raping the musician by Chief Magistrate Martha Mutuku. The ruling was made in the absence of the media, who were blocked by the magistrate from covering it.
The victim's lawyer stated that Magistrate Mutuku's ruling was reached at 'after only relying on the victim's testimony.'
