On August 8, 2019, a petition was submitted to the Judicial Service Commission seeking the removal of Chief Justice David Maraga from office.
The petition, filed by Mr. Yusuf Dimbil Ibrahim through Charles Koech & Associates, alleges that Chief Justice Maraga has engaged in corruption, abuse of office, tribalism, and impropriety, including attending political rallies.
Chief Justice Maraga's tenure has been marked by controversy since the nullification of the presidential poll in October 2017, which led to a loss of favor among some politicians and Kenyans.
Recent electoral petitions, including the Wajir gubernatorial election petition, have further strained relations between the Chief Justice and some politicians.
Mr. Dimbil's petition claims that Chief Justice Maraga had already made up his mind on the outcome of the Wajir election petition, citing a concurring opinion in the Laikipia gubernatorial petition delivered on February 8, which referenced the Wajir petition, which was not yet delivered on February 15.
Additionally, the petition accuses Chief Justice Maraga of attending political rallies, including a roadside stop in Kisii where President Uhuru Kenyatta, Raila Odinga, and the Deputy President were addressing the public.
According to procedure, the Judicial Service Commission will summon Chief Justice Maraga to respond to the allegations and make a decision on the petition.
