On August 7, 2019, Pwani Oil, a leading manufacturer of edible oil, filed a lawsuit against the National Land Commission (NLC) and the Kenya National Highways Authority (Kenha) over a Sh34.2 million award for the intended compulsory acquisition of its land in Jomvu, Mombasa County.
The company claims that the award was undervalued and that the NLC and Kenha failed to adhere to the relevant provisions of the law in arriving at the compensation.
Pwani Oil valued the two parcels of land at Sh181.1 million, significantly higher than the Sh34.2 million awarded by the NLC.
The company is seeking a permanent injunction to restrain the State agencies from acquiring or interfering with its possession and ownership of the land, except on payment of fair and just compensation to be assessed by the court.
The case will be mentioned on October 23, 2019.
