On August 7, 2019, Harambee Stars captain Victor Wanyama took to the Nairobi Milimani high court to seek justice for his image rights being violated.
The Tottenham Hotspur midfielder has sued Menengai Oil Refineries Limited for allegedly tweeting his image without his consent.
The tweet in question was purportedly meant to wish Harambee Stars well in the 2019 African Cup of Nations Championship, but Wanyama claims it was actually a marketing ploy to promote the company's business.
"If you believe it, you can do it, we at the Menengai would like to wish our boys all the best in the Africa Cup of Nations," the tweet read, accompanied by Wanyama's photo.
Wanyama argues that if the message was meant for the entire team, a photo of the entire team should have been used instead of just his image.
He is seeking a court declaration that Menengai Oil Refineries Limited's actions contravened his image and personality rights.
Wanyama also wants the court to declare that the image published by the company constitutes a marketing advertisement and to award him damages for the violation of his image rights.
