On August 3, 2019, the Kenya Revenue Authority (KRA) and Kenya Ports Authority (KPA) issued a public notice requiring all imported cargo destined for Nairobi and beyond to be transported on the Standard Gauge Railway (SGR) starting August 5, 2019.
However, the National Assembly has strongly objected to this directive, describing it as illegal since it was not approved by the House and did not undergo public participation.
According to National Assembly Majority Leader Aden Duale, the Government cannot punish traders in its bid to keep the multi-billion project operational. He argued that it was ridiculous for the Government to force people to use the SGR so that it can service its Chinese loans.
“The matter raised is very grave. You cannot kill a whole industry by saying all cargo should go through the SGR," said Mr Duale. "This country has a liberalised economy- what if you want to drop your container at Voi or Mlolongo?companies are being forced to use SGR without the element of consultation,” protested Duale.
The National Assembly has since adjourned its sittings to discuss the development and resolved to summon Transport Cabinet Secretary James Macharia to appear before the Transport Committee on August 7, 2019.
