On August 4, 2019, President Uhuru Kenyatta received a report from the tribunal led by Justice Alnashir Visram, which cleared Justice Ojwang of any wrongdoing.
According to the report, the tribunal found that the evidence presented against Justice Ojwang was insufficient to warrant his removal from office.
Justice Visram stated, “After adducing and analyzing all the allegations made against the Honorable Justice, the unanimous verdict is that the Judge of the Supreme Court Justice Jackton Ojwang is innocent of all the allegations made against him and that he should resume his duties immediately.”
Justice Ojwang's defense team, led by Nani Mungai, expressed relief and gratitude at the outcome, with Mungai saying, “The Judge feels vindicated by the cogent, objective and truthful findings of the Tribunal. In truth, no evidence regarding the Judge’s discharge of duty has ever existed.”
The tribunal's decision was a result of an investigation initiated by the Judicial Service Commission (JSC) in March 2019, following a petition by nine individuals alleging misconduct, incompetence, and breach of the judicial code of conduct against Justice Ojwang.
