On August 5, 2019, the tribunal investigating Supreme Court Judge Justice Jackton Boma Ojwang presented its findings to President Uhuru Kenyatta at State House, Nairobi.
The tribunal, led by Justice Alnashir Visram, declared Justice Ojwang innocent of all four allegations levelled against him, stating that the evidence presented did not meet the threshold to warrant his removal from the bench.
“After adducing and analysing all the allegations made against the Honorable Justice, the unanimous verdict is that the Judge of the Supreme Court Justice Jackton Ojwang is innocent of all the allegations made against him and that he should resume his duties immediately,” Justice Visram said.
The investigation was initiated in response to a request by the Judicial Service Commission (JSC) made on March 19, 2019, following a petition by Mr Nelson Oduor and eight others.
The tribunal considered evidence presented by 25 witnesses and applicable legal principles before arriving at the conclusion that Justice Ojwang was innocent.
President Kenyatta thanked the tribunal for executing its mandate judiciously, saying, “you have done very well in promoting human justice”.
