On August 1, 2019, Anne Thumbi Muthoni successfully petitioned the court to stop the burial of Ken Okoth, citing that she and the late MP had a child together.
According to Muthoni, she and Okoth had an intimate affair and got a baby boy. The family of the late MP, however, challenged the court's decision, arguing that there was no justifiable reason to prevent them from burying their kin.
As a result, the two parties signed an agreement allowing funeral plans to proceed pending DNA results to confirm the minor's fatherhood.
Ken Okoth's family insisted on a DNA test to determine the boy's paternity, which was to be done on August 2, 2019. The family's lawyer, Edwin Sifuna, stated, 'If she is not looking for an opportunity to embarrass our brother, if the motivation is to prove the paternity, there is no reason for keeping Okoth in mortuary until August 9.'
Anne Muthoni met Okoth in 2013 while working as a cleaner under the National Youth Service (NYS) slum upgrading exercise in Kibra and later Sonko Rescue Team.
