On August 2, 2019, the family of the late Kibra MP Ken Okoth moved to court seeking to quash a court directive to stop the interment of Okoth.

The mother of the Late Kibra MP Ken Okoth, Angeline Ajwang, and his wife Monica argued that there was no dispute surrounding the interment plan of the Late Okoth.

However, Anne Thumbi, a nominated MCA in Nairobi, had moved to court on Thursday to request for an injunction stopping Okoth's funeral plans, until Ajwang and Monica recognised her 3-year-old son as a scion of the late MP.

According to Edwin Sifuna, the family's lawyer, Thumbi had refused to subject her son to a DNA test before Okoth's death.

The court directed that the interred plans set for Saturday be stopped until the case was heard and determined.
