On August 3, 2019, a Nairobi court issued an order temporarily stopping the burial or cremation of late Kibra MP Ken Okoth, who passed away on July 26, 2019, due to colorectal cancer.
The court's decision came after Anne Muthoni Thumbi, a Nairobi MCA and alleged second wife of the late MP, filed an application to have her son recognized before his 'father' is interred.
Senior Principal Magistrate Mmasi named Angelina Okoth, the MP's mother, his wife Monica Okoth, and Lee Funeral Home as defendants, while Thumbi was named as the plaintiff.
The court ordered Thumbi to serve the respondents immediately before the hearing on August 9, 2019.
Thumbi, who is ready for a DNA test, wants to be recognized as one of the wives of the late MP.
Nairobi Governor Mike Sonko had previously claimed that the late Okoth had a son with Thumbi, whom he met in 2013 during a medical camp hosted by the Sonko Rescue team in Kibra.
Thumbi and her son have been excluded from the burial arrangements for Okoth, with the family allegedly planning to cremate the MP to destroy any evidence of the alleged son's paternity.
