On August 2, 2019, the Supreme Court gave the National Assembly and Senate a 14-day ultimatum to resolve the division of revenue between the national and county governments.
The advisory was prompted by a dispute between the two Houses over the allocation of Sh316 billion to counties, which is backed by the Treasury.
Senate had approved Sh335 billion, while a mediation committee settled on Sh327 billion.
However, the Treasury, led by acting CS Ukur Yatani, refused to budge on its offer, ruling out further talks with the governors on the matter.
Chief Justice David Maraga urged the two Houses to resolve the issue amicably, warning of an impending constitutional crisis.
Justices Mohammed Ibrahim, Smokin Wanjala, Njoki Ndung'u, and Isaac Lenaola set August 15 for the hearing of the dispute should the two Houses fail to agree.
