A Nairobi court has intervened in the funeral arrangements of late Kibra MP Ken Okoth, issuing a temporary injunction to prevent his cremation or burial until a case filed by Anne Muthoni Thumbi is heard and determined.
The court's directive, issued on August 1, 2019, bars Okoth's family from disposing of his body or remains in any manner until the case is resolved.
Ms. Muthoni, a Nairobi County nominated MCA, filed a lawsuit on behalf of a minor, who she claims is Okoth's biological son.
She has named Okoth's mother Angeline Okoth, his wife Monica Okoth, and Lee Funeral Home as respondents in the case, alleging that they unilaterally decided to cremate his body to destroy any evidence of the boy's lineage.
Speaking at Okoth's funeral service, Governor Mike Sonko claimed that the late politician had a second wife, Ms. Muthoni, and a child named Okoth with her.
The matter will be heard on August 9, 2019, before Senior Principal Magistrate Hon. Obura.
