At a recent national integrity conference in Nairobi, Makueni County Governor Prof Kivutha Kibwana highlighted persistent corruption challenges in Kenya, emphasizing the need for structural reforms and political commitment to eradicate graft.
Kibwana noted that from 1963 to 2002, public officials operated under a culture of impunity, with corruption perceived as an accepted practice. He argued that current efforts to combat graft require more than moral appeals, citing the need for legal mechanisms to hold leaders accountable.
The governor referenced Section 62 of Kenya's Anti-Corruption and Economic Crimes Act, which mandates suspension of public officers charged with corruption. However, he pointed out that politicians remain exempt, allowing accused individuals to retain power and potentially intimidate witnesses.
Kibwana advocated for implementing provisions from the 2004 Bomas Draft Constitution, which would require public disclosure of state officers' assets. He also supported using the 2010 Constitution to enable periodic wealth audits of public officials, building on existing asset declaration requirements for job applicants.
The discussion included proposals for plea bargaining in corruption cases, emphasizing asset recovery to prevent unjust enrichment. Kibwana acknowledged debates around amnesty programs for corrupt individuals who return ill-gotten gains, while stressing the importance of custodial sentences for high-profile offenders to deter others.
Referencing the book The Prosperity Paradox, Kibwana argued that sustained economic growth could reduce corruption incentives. He maintained that establishing a constitutional anti-graft commission with investigative and prosecutorial powers remains critical, even as he acknowledged the need for broader societal shifts in values.
The governor concluded by urging citizens to support President Uhuru Kenyatta's anti-graft efforts, drawing parallels to the biblical story of Jesus' admonition against judgmentalism in addressing corruption.
