Two directors of Ruiru-based alcoholic drinks manufacturer Platinum Distillers have filed a court petition to reopen their factory, which was sealed by authorities last month over alleged tax evasion.
John Waweru Ndegwa and Onesmus Muturi Mburu, through lawyer Chris Kabugu, argue that Kenya Revenue Authority (KRA) actions violate their constitutional rights to property and business. The directors claim KRA placed customs seals on the premises, blocking access and disrupting operations.
Kabugu told the High Court that the closure caused significant harm to the business and affected hundreds of employees. He described KRA's actions as "manifestly unlawful" and "based on legal error," requesting the court to order the agency to unlock the facility and return seized documents.
KRA defended its actions, stating the company was under investigation for evading Sh14 million in taxes. The agency also cited ongoing probes into ethanol imports, seeking 30 days to complete inquiries. A ruling on the reopening is scheduled for March 14, 2019.
