Speaker of the National Assembly Justin Muturi postponed consideration of a Public Accounts Committee (PAC) report scrutinizing the Independent Electoral and Boundaries Commission (IEBC) in March 2019, citing unresolved constitutional questions.
The report recommended removal of IEBC commissioners and its chair, triggering parliamentary debate over its legal validity. Majority Leader Aden Duale argued the proposals violated Article 251 of the Constitution, which governs procedures for removing officials of independent constitutional bodies.
Otiendo Amolo, a PAC member, countered that the report aligned with Article 95, which permits parliamentary processes for removing IEBC officials. He urged the Speaker to allow further discussion and amendments rather than dismissing the report entirely.
Muturi indicated he would issue a ruling by the following week after reviewing constitutional implications. The delay highlighted tensions between legislative oversight and protections for independent institutions under Kenya's constitutional framework.
