The Director of Public Prosecutions (DPP) has denied former Nairobi Governor Evans Kidero's bid to face trial separately from co-accused officials, stating the move risks procedural prejudice. The prosecution argued consolidating trials would prevent redundant witness testimony and ensure consistent adjudication of shared allegations.
Prosecutor Joseph Riungu emphasized that Kidero's legal team did not challenge the charge sheet's structure during prior court sessions. The case involves 35 corruption-related charges, including conspiracy, abuse of office, and fraudulent acquisition of public assets, stemming from a Sh213.3 million loss to Nairobi County Government between 2014 and 2016.
Allegations include unauthorized payments to contractors and Kidero's receipt of Sh24 million in illicit payments from Lodwar Wholesalers Ltd in 2014. The prosecution dismissed claims of intentional charge fragmentation, noting no objections were raised during pre-trial directions.
Chief Magistrate Douglas Ogoti will consider the application on Thursday, following Kidero's March 4, 2019, court appearance where he was seen in custody.
