More than 70 individuals associated with the Kanu regime have withdrawn a legal challenge to secure land titles in Eldoret, where a 800-acre property originally belonging to widow Ann Kimitei remains at the center of a decades-old dispute.
The plaintiffs, including former Kenya Pipeline Company MD Ezekiel Komen and former Eldoret mayor Josiah Magut, filed a notice to withdraw their case at the Lands and Environment Court. Their legal team, led by Z.N Gathaara, stated the suit was dismissed with immediate effect.
The land, registered under LR No 9723/IRI 5449/II and valued at over Sh2 billion, is located near the University of Eldoret. It was seized from Kimitei's late husband, Kimitei Nyongio, who died in June 1988 after being detained for resisting land takeover.
A 2012 court ordered arrests for Komen and four others over allegations of land fraud, though all were later acquitted. The High Court had previously invalidated titles issued to the land between 1988 and 2012. Kimitei's family has fought for possession since the 1990s, with over 200 families now facing potential eviction.
The widow's legal team announced plans to seek court-issued eviction orders, following the withdrawal of the title claims. Ministry of Lands officials confirmed the land remains registered in Kimitei's name.
