The National Land Commission (NLC) has mandated the return of 352 acres across Kwale's Wasini and Funzi islands to two families following court-ordered land restitution. The Saggaf family will regain 289 acres valued at Sh1.3 billion, while 83-year-old Hamisi Mwatende will reclaim 63 acres on Funzi Island.
A March 1 gazette notice confirmed the NLC's enforcement of a 1995 High Court ruling that awarded the Saggaf family ownership of Plot Number W33/Kwale/Wasini. The commission directed the Chief Land Registrar to revoke unauthorized titles and issue new documents, citing a 1997 court order canceling deeds held by non-family members.
The Saggaf family, represented by member Muhammad Sharrif Saggaf, reported ongoing challenges in reclaiming their land. They accused local authorities and seven hotel operators of obstructing their efforts, alleging the businesses illegally occupied the property and engaged in mineral mining. "We are awaiting court approval to evict them," Saggaf said, noting the family's struggle to implement previous rulings.
The NLC recommended alternative dispute resolution to address squatter conflicts but emphasized its role in facilitating negotiations. The commission acknowledged historical injustices against the family, who presented documents proving ownership inherited from patriarch Saggaf Alawy, 99, and his children Hassan Nassir, Muhammad Nassir, and Ahmed Nassir.
On Funzi Island, the NLC ordered the return of 63 acres to Mwatende, who has lived in a thatched hut despite owning Plot L.R. No. KWL/FUNZI/64. The commission identified five individuals, including Italian tycoon Alessandro Torriani, as claimants to the land. Previous investigations found unclear transfer records, though Torriani had previously listed the island for sale at $16 million (Sh1.6 billion), prompting government intervention.
