The Nairobi High Court postponed the trial of former Governor Evans Kidero on fraud charges to April 3, 2019 after his legal team argued the prosecution's charge sheet failed to meet legal standards. Kidero's attorney James Orengo contended that the conspiracy to commit fraud charge lacked specific details required under the Anti-Corruption Act, stating, "A defective charge sheet renders a trial impossible."
The defense also claimed prosecutors had not yet provided essential documents. Prosecutor Joseph Irungu responded that procedural issues could be resolved during court submissions, emphasizing the charge sheet's compliance with legal definitions. "Each count clearly outlines the alleged actions," he asserted.
The court acknowledged the defense's pre-trial objections but maintained the charge sheet's validity. All accused parties, including Kidero, entered not guilty pleas. The judge noted the defense's timing of the challenge, stating, "This application could have been made earlier."
