Huawei Technologies Co Ltd's chief financial officer, Meng Wanzhou, has filed a civil lawsuit in British Columbia Supreme Court against the Canadian government, border agency, and federal police. The case, initiated in 2019, alleges her December 1, 2018, detention at Vancouver International Airport violated constitutional protections. The lawsuit claims Canadian Border Services Agency (CBSA) officers unlawfully delayed executing an arrest warrant and conducted searches of her electronic devices and luggage without proper legal authority.
Meng was arrested at the request of the United States, which accuses her of bank and wire fraud related to alleged Iranian sanctions violations. The civil suit argues that evidence obtained during her three-hour detention breached the Canadian Charter of Rights and Freedoms, including the unlawful seizure and examination of her devices and personal effects. CBSA officers reportedly searched her luggage and compelled her to surrender electronic devices, later accessing their contents without legal justification.
The lawsuit contends RCMP officers executed the arrest warrant only after an unlawful detention, during which Meng was interrogated. Canadian authorities have not publicly commented on the allegations, though the CBSA stated it would not address matters under judicial review. Meng, released on bail, is scheduled for a court appearance in Vancouver to set an extradition hearing date following the government's approval of the extradition process.
China has criticized Canada's handling of the case, reiterating demands for Meng's release. The legal battle highlights tensions between Canada, the U.S., and China over Huawei's global operations and allegations of national security risks.
