Nakumatt Appeals Order to Vacate Mombasa Space

On July 28, 2019, Nakumatt Holdings appealed an order issued by Justice Charles Yano of the Lands Court on March 5, 2018, directing the company to vacate its former premises at City Mall in Nyali, Mombasa.

The order also required Nakumatt to pay Sh27.8 million in outstanding rent, service charge, and promotion fund as of November 1, 2017.

Nakumatt argued that the Lands Court did not have the jurisdiction to hear and determine the application, citing express orders of stay emanating from insolvency proceedings at the High Court in Nairobi.

However, Ideal Locations Ltd, Nakumatt's former landlord, opposed the appeal, arguing that the Lands Court had the jurisdiction to determine its application.

Shoprite, a South Africa-based retailer, has recently signalled its intention to open its third Kenya store at the premises next month.
