On Friday, 26 July 2019, the Universities Academic Staff Union (Uasu) filed a case at the Labour Court to stop the planned merger of 31 public universities by the government.
The union, represented by Koceyo & Company, has sued Education Cabinet Secretary Prof George Magoha and Attorney General Kariuki Kihara, with the case set to come up for hearing on 1 August.
Uasu claims that the proposed merger is being undertaken unilaterally by the government without due regard to other stakeholders, and that it is not aligned with any national educational policy goal.
According to the petition, some public universities have already begun eliminating certain disciplines, departments, and schools in anticipation of the proposed mergers, which would amount to restructuring under the Employment Act.
However, the union argues that the government has not complied with the law relating to restructuring under Section 40 of the Employment Act.
