Lady Justice Janet Mulwa has barred the first family of billionaire Stephen Kung’u from evicting his three grown children from a Hurlingham apartment in Nairobi.
The court order also prohibits any property from being ruined or alienated until the matter of the estate's distribution is heard and determined. This comes after the first family, including Mr Kung’u's first wife, Ms Grace Nyambura, and her four children, who manage enterprises worth over Sh50 billion, were accused of attempting to transfer properties to themselves.
Estate Distribution Dispute ¶
According to Lawyer Tom Ojienda, the first family influenced the eviction of Ms Naomi Wambui Kung’u and her sisters Rahab Wamucii Kung’u and Bilha Wanjiku Kung’u from the palatial house owned by the billionaire. The court heard that Ms Wamucii was forcefully ejected from Monte Carlo Club, which she managed before Mr Kung’u's death on April 6 this year.
Ms Wamucii was later taken to Central Police Station, where she was locked up but released after her lawyers intervened. Prof Ojienda stated that the second family is concerned that the first family wants to deny them a share of their father's estate.
Petition to Safeguard Estate ¶
The three siblings protested that there were plans to change signatories and registered directors of various companies, and that massive withdrawals and transfers from their father's bank accounts were attempted. They urged their stepmother, stepbrothers, and stepsisters to take out a letter of administration to allow them to benefit from the estate as they did when their father was alive.
Lady Justice Mulwa has directed that the petition to safeguard the estate be heard on October 7.
