Justice Phillip Waki, chairman of the 2007/08 post-election violence commission of inquiry, has asked a Nairobi court to dismiss a petition filed by David Matsanga, a Jubilee Alliance anti-ICC activist. The petition seeks to compel Waki to reveal the contents of the so-called Waki Envelope, which contains names of individuals allegedly marked for prosecution.
According to Waki, no person can force the production of documents that the law requires to be submitted to the President. The Waki Commission's 529-page report was presented to President Mwai Kibaki and Prime Minister Raila Odinga in October 2008.
