EACC Seeks Dismissal of Waititu's Application to Halt Prosecution

On July 22, 2019, the Ethics and Anti-Corruption Commission (EACC) filed a motion in court to dismiss an application by Kiambu Governor Ferdinand Waititu, who is seeking to halt his prosecution.

According to EACC, Waititu's application is premature and lacks merit, as he has not provided evidence of how his constitutional rights have been infringed.

The commission argues that the search warrants issued to investigate Waititu's accounts were lawfully issued pursuant to the constitution.

Waititu, on the other hand, claims that the search warrants were illegal and that the offences and crimes were not particularized in the warrants.

He wants the court to order EACC to return all documents, including cheque books, log books, title documents, and other items seized during the search.

Waititu and his family members, as well as top county officials, are being sought over alleged graft relating to Ksh.588 million road tenders.

”The application is frivolous, incompetent and improperly before court and an abuse of court process,” reads EACC's court documents.
