On July 22, 2019, the Director of Public Prosecution Noordin Haji issued a directive for the arrest of Treasury Cabinet Secretary Henry Rotich and Principal Secretary Kamau Thugge, among others, over the multibillion-shilling Arror and Kimwarer dams scandal.

According to Haji, the investigation had revealed sufficient evidence to charge 28 officials and entities, including Rotich, Thugge, Dr. Susan Jemutai Koech, and former Kerio Valley Development Authority Managing Director David Kimosop.

The DPP questioned why the National Treasury increased the initial funding of the two dams from Ksh 46 billion to Ksh 63 billion without regard to performance or works done.

Rotich and Thugge were to be charged with eight accounts, including conspiracy to defraud, failure to comply with procurement procedures, abuse of office, and fraudulent accusation of public property.
