ICC judge, Chile Eboe Osuji, asked ICC Chief Prosecutor, Fatou Bensouda, to provide compelling reasons for admitting the original statements of six witnesses who have since recanted their testimonies in Deputy President William Ruto's case.
Osuji, the case presiding judge, noted that the prosecution would face a challenging task in convincing the judges to admit testimonies from dead or false witnesses.
Bensouda had requested the judges to invoke Article 68 of the Rome Statute, allowing the admission of testimonies from dead and false witnesses. However, the prosecution later seemed to retreat, stating that the rule should not be applied to the detriment of Ruto and Sang.
