On July 19, 2019, High Court Judge Hatari Waweru overturned a four-year prison sentence handed down to Michael Kimondo in May 2018 for stabbing his wife and her lover.
Kimondo had appealed the sentence, arguing that it was excessive given the circumstances of the case.
The High Court agreed with Kimondo's appeal, ruling that he was unfairly punished.
According to court documents, Kimondo stabbed his wife and her lover in September 2014 at their home in Naromoru, Nyeri County, after returning home unexpectedly and finding them together.
"Njuguna returned home suddenly from work and found his wife and another man in their bedroom in a compromising position. In anger, he attacked the two with a knife and left them with serious injuries," court documents stated.
Judge Waweru cited the need for proportionality in sentencing, saying that the punishment should be commensurate with the offense.
"We live in a new generation, but it will be wise to avoid chaos and not take the law into our own hands, because if everyone is given the freedom to do as they please, we will be living like wild animals," Judge Waweru said.
