More Parties Join Governors' Petition Over County Funds

On July 19, 2019, the Supreme Court heard a petition filed by the Council of Governors and 47 county governments over the Division of Revenue Bill, 2019.

More parties have since expressed interest in joining the case, including the Commission on Revenue Allocation, the Law Society of Kenya, the Katiba Institute, county assemblies, the Controller of Budget, and speakers of both the National Assembly and the Senate.

State lawyer Emmanuel Bitta, representing the Attorney General, indicated that he would object to the capacity of parties allowed to participate in the suit due to the large number of interested parties.

However, the other parties and the Chief Justice, David Maraga, indicated that the matter before the top court was open to all parties.

Chief Justice Maraga ruled that all parties should file documents seeking to join the petition by 4pm on Monday, with the case set for mention on Tuesday next week.

He also indicated that if parties were ready, the hearing could proceed on Wednesday.
