On July 17, 2019, Siaya MCA Joseph Mboha was suspended for 28 days for gross conduct, just hours after a High Court order lifted his earlier suspension. The suspension was issued by County Assembly Clerk Eric Ogenga in a letter accusing Mboha of attempting to storm into the assembly precincts with rowdy youths.
According to the letter, Mboha was also accused of jumping over the assembly security wall with the help of goons and assaulting an assembly staff who was trying to restrict his disorderly behavior.
This is the third suspension Mboha has faced following a fallout with his colleagues. He was first suspended on May 2 over claims of gross misconduct, and the suspension was later lifted temporarily by the High Court after he filed a petition.
On May 7, Mboha was suspended again after five petitioners sought to have him removed from office. The latest suspension comes despite a court order lifting his earlier suspension, which Mboha served on the assembly on Tuesday.
Speaker George Okode stated that the assembly received the order on Wednesday morning, but Mboha's behavior was deemed to be in violation of the Powers and Privileges Act, 2017, and the Siaya County Assembly Standing Orders.
