Two employees linked to Mugo wa Wairimu have been released on Sh200,000 cash bail or a Sh500,000 bond after a Milimani court found no strong basis to keep them in custody.
The ruling was made on Tuesday, November 20, 2018, by Magistrate Martha Mutuku, who said the prosecution had not shown that Victor Kamunya, also known as Doctor Victor, and Risper Ouma were flight risks.
“There are no compelling reason or basis for denying the accused bail, the prosecution failed to prove that the accused are a flight risk,” Mutuku said.
The two are accused of running Millan Health International Limited in Kayole, Nairobi, without registration by the Kenya Pharmacy and Poisons Board. Court records also say they were found operating the business on November 3 at the Kayole premises without the board’s authorisation.
They face a second count of operating a pharmacy in premises not registered by the board, as well as a charge of running a medical laboratory without a licence from the Kenya Medical Laboratory Technicians and Technologists Board.
Prosecutors further allege that Kamunya and Ouma presented themselves as doctors to Kenya Medical Practitioners and Dentists Board chief executive Daniel Yumbya. The pair are also said to have used the title “doctor” without the required academic qualifications.
Both men denied the charges at the Milimani law courts. They told the court they were students and had only been working at the pharmacy as interns.
The court had earlier detained them for a week pending production of a probation report. The matter was set for mention on December 4, 2018.
