On 2nd March 2018, Rajeev Modi, a director of Galot Industries Limited, swore an affidavit before Alice Jonathan Gulenywa, a commissioner for oaths, stating that he was a director of the company, Manchester Outfitters Limited, and King Woolen Mills Limited. However, this statement was later found to be false.
Modi was charged with perjury and false swearing, with the court hearing that he had attempted to have a criminal case withdrawn by purporting to be a director of the said companies.
On 2nd February 2018, Modi, Mann, and Togo commenced a meeting purportedly as directors and company secretary respectively, and nominated Modi to swear an affidavit for purposes of withdrawing a criminal case, which they knew to be false.
The trio denied the charges before Chief Magistrate Wendy Kagendo, with their lawyer, Kiraithe Wandugi, requesting lenient bail due to their consistent attendance in court for the past three years.
Wandugi also requested that the file be declared a safe file due to documents disappearing from it, and that the prosecution supply the defense with a copy of the OB and the investigation diary.
On 30th May 2022, the court released the trio on a cash bail of Sh 200,000 each, with the matter to be mentioned on 9th June 2022.
