Government Sued Over Passing of Appropriation Bill 2019

On July 15, 2019, the government faced a court challenge over the passage of the Appropriation Bill 2019, which was signed into law by President Uhuru Kenyatta without incorporating the Division of Revenue Bill.

The Appropriation Bill mandates the National Treasury to release Ksh.161 billion from the Consolidated Fund to various government departments.

The Institute for Social Accountability (TISA) National Coordinator, Wanjiru Gikonyo, filed a petition arguing that the passage of the Appropriation Bill without the Division of Revenue Bill is illegal and unconstitutional.

Gikonyo stated that the Division of Revenue Bill is the foundation upon which the budgeting process, including the expenditure of public funds, is premised.

She added that the Division of Revenue Bill was yet to be agreed upon and duly passed by the two houses of parliament.

According to the petition, the passage and assent of the Appropriation Bill 2019 without the incorporation and inclusion of the Division of Revenue Bill 2019 is illegal and unconstitutional.

The Attorney General, the Council of Governors, Commission for Revenue Allocation, Kenya Human Rights Commission, Africa Center for Open Governance, and Transparency International Kenya have been named as respondents and interested parties in the case.
