On Monday, July 15, 2019, two suspects were arraigned in a Nairobi court after they were allegedly found in possession of a kitchen knife on Moi Avenue in the capital's Central Business District (CBD).

According to police officers who arrested them, the weapon was dangerous and an indication that they had intent to commit robbery.

Charles Marwa and Jackton Ondego, who were arrested on Friday, were charged with preparation to commit a felony contrary to Section 308 of the Penal Code.

Appearing before Magistrate Kennedy Cheruiyot, the duo denied the charges, instead claiming they were assaulted by officers from Central Police Station.

Marwa complained that he was brutally caned by the officers, leaving him with head, chest, and arm injuries.

He also told the court that the officers took Ksh.11,300 from him, money that was not recorded in the case file as an exhibit.

Ondego claimed that the officers put soil in his mouth when he tried screaming for help from passers-by.

The prosecution, however, told the court that the two accused persons were beaten by members of the public.

The magistrate released them on a cash bail of Ksh.20,000 and directed that they be taken to hospital.
