On 25th March 2017, a land sales agreement was executed between Bunmax Investments Limited and Farasi Marketing Limited at Wambugu and Muriuki advocates office at Lonrho house in Nairobi. However, the agreement was allegedly executed by falsely pretending that it was executed by genuine and valid directors of Bunmax, a fact the accused knew to be false.
Lawyer John Kiumi Wambugu and his client Allan Mbugua Njuguna have been accused of conspiring to defraud Bunmax Investments Limited of their land LR 209/8524/129, IR 91699. They are alleged to have committed the offence jointly with others not before court.
Njuguna was also charged with personification by presenting himself as a director of Bunmax Inv. He is also charged with forging a land transfer form between the two companies purporting it to be genuine.
On 13th July 2017, the forged land transfer form was allegedly uttered to the Chief Land Registrar at Arthi House in Nairobi, purporting it to be genuine and executed by the directors of the two companies.
On 11th April 2022, the two denied the charges before Chief Magistrate Wendy Kagendo at Milimani Law Courts.
Wambugu had opposed pleading to the charges, citing that the charges against him were yet to be approved by the DPP. He claimed that the charges emanated from his discharging his duties as an advocate.
However, the prosecution objected the application opposing plea taking, stating that the charge sheet is not defective and there is no stay for the same. The Magistrate noted that the charge sheet is duly stamped and directed the two to plead to the charges against them.
Njuguna was granted a bond of Sh 1 million while Wambugu was granted a cash bail of Sh 100,000.
