KenolKobil Sues Landlord Over Eviction Threat

On July 14, 2019, KenolKobil, an oil marketer listed on the Nairobi Securities Exchange under the ticker KENO, took legal action against its landlord, Canarian Holdings Ltd, over alleged threats to evict it from two parcels of land in Mombasa and Kilifi.

The oil marketer operates its petrol stations on the parcels of land in Jomvu, Mombasa, and Kilifi. KenolKobil is seeking a permanent injunction to restrain Canarian Holdings Ltd from harassing, intimidating, or evicting it and its licensees or agents from the properties.

According to the suit papers, Canarian Holdings Ltd has threatened to interfere with KenolKobil's peaceful occupation of the properties before the expiry of the term under the leases. The oil marketer argues that it is apprehensive that unless the court prohibits Canarian Holdings, it will evict it from the properties, occasioning harm, loss, and damage.

KenolKobil leased the parcel of land in Jomvu by a lease agreement dated August 23, 2001, for 20 years from November 1, 2000. The oil marketer also leased land in Kilifi for 20 years from February 1, 2002, by another agreement dated April 19, 2000.

Clara Jepkorir, a retail supervisor at KenolKobil, stated that the terms of leases are yet to expire and that the firm has complied with all conditions of the leases in terms of payment of rent, which have been made in a timely manner.
