On July 13, 2019, the Labor Court in Nairobi delivered a significant ruling against the Teacher Service Commission (TSC), declaring its Teacher Professional Development (TPD) program modules unlawful.

The court directed TSC to convene a meeting by December 1, 2019, to finalize teacher appraisal tools for rollout in January 2020.

According to the court, the TPD program aimed to monitor teachers' conduct and performance in the teaching service, with all registered teachers required to undertake continuous professional development courses.

However, the court ruled that the program fell short of professional development standards, stating, "The Teachers Professional Development (TPD) modules in dispute shall not be implemented as they fall short of professional development program. This court declares that notice of withdrawal of teachers dated December 2018 is set aside."

The court's decision is a major victory for teachers, as it also directed TSC to undertake teachers' promotion in accordance with the relevant provisions and the scheme of services.
