Kenya Airways CEO Ordered to Pay Sh10 Million for Unlawful Sacking

On July 11, 2019, a Nairobi court made a landmark ruling in favor of Kepha Moreno Bosire, a former Corporate and Communication Manager at Kenya Airways, who was unlawfully sacked by the airline's former CEO, Titus Naikuni.

Justice Nelson Abuodha ruled that Naikuni's actions against Bosire were without justifiable cause, and ordered the former CEO to pay a total of Sh10 million in damages.

The court awarded Bosire Sh1.8 million for three months' salary in lieu of notice, Sh12 million for 12 months' salary compensation, and Sh1 million for compensation for undignified treatment.

According to the court, Naikuni personally confronted Bosire during a marathon event at Lemek Conservancy in 2013, removed his t-shirt, and said it did not bear the company's logo.

The court noted that Naikuni should have used alternative measures to ask Bosire to leave the event, rather than embarrassing him in front of his colleagues and other guests.

The judge further found that Naikuni authorized the Director of Human Resources to dismiss Bosire, without affording him a fair hearing or a chance to defend himself as required by the Employment Act.
