On March 29, city lawyer Assa Nyakundi accidentally shot his son Joseph Nyakundi in Muthaiga, leading to a manslaughter charge. However, the Director of Public Prosecution Noordin Haji has now applied to drop the charge and substitute it with murder.
According to the DPP, a ballistic examination contradicted earlier statements recorded by Nyakundi, revealing that the lawyer had directly aimed at his son's chest.
“Nyakundi’s claim that the firearm accidentally discharged while he was picking it from its holster could not stand and after ballistic examination, there is evidence of direct shooting by aiming at the deceased chest,” said the DPP.
The DPP further accused the lawyer’s family of attempting to cover up the murder and a bar tender, known to the family, of trying to frustrate efforts to prosecute Nyakundi.
Following the revelations, Directorate of Criminal Investigations boss George Kinoti interdicted two police officers assigned to probe the killing, and a manhunt has been launched for the bar tender who is on the run.
