A Nairobi court has intervened in a paternity dispute surrounding the late Kibra MP Ken Okoth, issuing a temporary injunction to prevent his family from cremating or burying him until a case filed by Anne Muthoni Thumbi is heard and determined.
The court's directive, issued on August 1, 2019, bars Okoth's mother and wife from disposing of his body or remains pending the hearing and determination of the case.
Ms. Muthoni, a Nairobi County nominated MCA, claims that Okoth's family unilaterally decided to have his body cremated in order to destroy any evidence of the boy's lineage to the deceased.
She has named Okoth's mother Angeline Okoth, his wife Monica Okoth, and Lee Funeral Home as respondents in the case, alleging that they have deliberately excluded her from the funeral and burial arrangements.
The matter will be heard on August 9, 2019, before Senior Principal Magistrate Hon. Obura.
Speaking at Okoth's funeral service, Governor Mike Sonko claimed that the late politician had a second wife, Ms. Muthoni, and a child with her.
