July 8, 2019 - Nairobi, Kenya - Chama Cha Mawakili (CCM) has taken the High Court to challenge the appointment of former Chief Justice Bernard Chunga to a taskforce on the establishment of an Inspectorate in the Office of the Director of Public Prosecutions.
CCM, a lobby group made up of lawyers, is opposed to Chunga's appointment as chairman of the taskforce, citing that the selection was not based on merit or fair competition.
The group claims that there was no advertisement or communication made to the public on the existence of the position, and that no interviews were carried out.
“The appointment is unconstitutional as it is not based on principles of accountability, merit and competition,” states the group.
CCM now wants the appointment suspended pending determination of the dispute.
The lawyers claim that Chunga's choice has rekindled the bad memory of many of his victims from his actions when he served as Deputy Public Prosecutor and Chief Justice.
The Truth Justice and Reconciliation (TJRC) report had recommended that he should never hold public office over injustices that occurred during his reign.
