On November 29, 2021, the Ethics and Anti-Corruption Commission (EACC) wrote to the Nairobi County Assembly Speaker, Benson Mutura, stating that Paul Mutungi was facing corruption charges in court and was not fit to hold public office.

However, in a move that has sparked controversy, the Speaker has dismissed the EACC's concerns, stating that Mutungi had already been cleared by the Assembly and that the EACC had failed to raise any objections during the public hearing.

"Is it not strange that EACC was nowhere to be found during the public hearing?" the Speaker asked.

"We had invited the public to participate in the process, but EACC chose to remain silent. They only raised objections after the fact," he added.
