Published on November 5, 2021, a magistrate's court in Kenya has ordered the Director of Public Prosecutions (DPP) to amend the charge sheet in a Sh588 million corruption case involving former Kiambu governor Ferdinand 'Baba Yao' Waititu.
Waititu, his wife Susan Wangari, and nine co-accused are set to face additional graft charges after losing Sh52 million in a court dispute over a failed real estate transaction.
Anti-corruption court chief magistrate Thomas Nzioki allowed the DPP to introduce a new charge of dealing in stolen public property against Waititu and his company, Saika Two Estate Developers Ltd.
According to the magistrate, 'in the interest of justice, I find that the application by the Director of Public Prosecutions has merit and the court allows it.'
Waititu is expected to answer a new charge of authorising payment of Sh6 million belonging to the Kiambu County Government to Lake Naivasha Resort Ltd, which allegedly occurred between August 27 and September 27, 2018.
The matter shall proceed on November 16 when all the accused persons will take plea to the fresh charges.
