EACC Wins Case Over Kenya Railways Kisumu Land Valued at Ksh. 35 Million

On Thursday, the Environment and Land Court in Kisumu ruled in favor of the Ethics and Anti-Corruption Commission (EACC) in a case against Kenya Railways and two private investors over land in Kisumu valued at Ksh. 35 million.

The case, presided over by Justice S. M. Kibunja, involved two private investors, Okongo Oyoo and Sammy Komen Mwaita, who had leased the land from the Kisumu County Government.

The EACC had urged the court to cancel the lease under Kisumu Municipality/Block 7/542 and revoke the Certificate of Lease issued to one of the defendants, with the aim of restoring the land to Kenya Railways.

The Commission also sought a permanent injunction against the first defendant, his agents, servants, or representatives, to restrain them from leasing, transferring, charging, entering upon, developing, or in any other manner dealing with the railways land.

Earlier this year, Kenya Railways Corporation submitted to EACC close to 500 cases countrywide involving its parcels of land said to be illegally acquired by private investors.
